Unite have just announced that they will now not be appealing the Employment Tribunal's decision in the case of Bear Scotland v Fulton, regarding overtime to be included in holiday pay calculations.
This means that the risk of employees claiming for backdated holiday pay up to 1998 is greatly reduced.
Whilst the principles involved may be challenged in the future, it is positive news for employers.
