Statutory questionnaires are being abolished in discrimination cases

Napthens - March 27th 2014

From 6 April 2014 the statutory discrimination questionnaire procedure will be abolished and has been replaced with informal guidance from ACAS.

The guidance provides details on how complainants can ask questions of their employer and why and how employers should respond. The guidance can be read online.

Employers are encouraged to follow this guidance and provide accurate answers to informal questions. Note that employers who fail to follow this guidance will risk adverse inferences from the Employment Tribunal.
