Helen Lucking - Partner, Head of Family and Divorce

Helen is a specialist in matrimonial finance, particularly high net worth cases, advising clients who have business interests and large pensions on the financial issues arising from the breakdown of their relationships. Many of her clients are directors of businesses and business owners.

Helen has a pragmatic and straight-talking approach with her clients, involving them fully in all decisions made on their case. She is strongly supportive of her clients through what can be a stressful time for them and their family and vigorously pursues their aims to achieve the best possible outcome for them.

In 2012 Helen trained and qualified with Resolution as a collaborative lawyer.

When dealing with collaborative cases, Helen promotes a constructive, non-confrontational approach to divorce and children matters. She tailors her approach to each client’s needs and always aims to ensure clients reach a settlement which is right for them and their family.

Helen believes in the importance of financial planning when embarking upon a relationship and regularly advises clients on the benefits of entering into pre-nuptial and cohabitation agreements at the start of any new relationship.

Experience

Helen represents clients in all areas of family law including children matters. She is one of only a handful of specially trained collaborative family lawyers in Lancashire.

Helen often represents clients of Napthens when they require advice on divorce and family law issues.

Recent cases include:

  • Assisting a client with the preparation of a premarital agreement, where the wife wanted to protect extensive family wealth, including assets, held in trust
  • Representing a husband in financial proceedings, where there was legal argument over whether a family business he was running was a pre-acquired asset and whether other investments in his name were non-marital
  • Representing a husband against two simultaneous claims. The first claim was by his ex wife, made some years after their separation. The second claim was by his current wife from whom he had recently separated
  • Representing NHS consultants and advises on complex pension issues and financial settlements following their divorce
  • Representing a parent in an application for a change of residence where there were alcohol and drug issues
  • Representing people who run their own business, including farmers. This work often involves advice as to protection of assets, including pre-and post marital agreements
