Equality Act 2010 – is your Equal Opportunities policy compliant?

The first wave of implementation of the Equality Act 2010 will occur on 1st October 2010. The Act consolidates and harmonises complex discrimination legislation and introduces significant changes to existing legislation and case law.

Employers should review and amend their existing policies to reflect the changes introduced and ensure they fully comply with the law. As well as having up-to-date employment policies in place, employers should ensure that managers are properly trained on their equality obligations and that there are effective procedures in place to deal with complaints. This will help employers avoid claims and may provide a defence where claims do arise.

With average compensation figures of £18,584 for race discrimination, £19,499 for sex discrimination and £52,087 for disability discrimination, this is a costly area of law which cannot be ignored.
