Lost wills

Wills are personal documents often written years before the writer’s passing. With time, they may become difficult to trace.

When a will is made, it is often kept safe by the firm of solicitors who drew it up. It might be registered with Certainty, the national will register.

Some people prefer to keep their will at home. If, after the writer’s death, a reasonable search has been made but  a will cannot be found, it is presumed to have been destroyed by the writer with the intention of revoking it.

It may be possible, however, to present witness evidence that this was not the deceased’s intention, or to apply for probate on a copy will if a copy is in existence and there is witness evidence to show the original has been lost and not revoked.
