Rosemary is a legal director in the wills, trusts and probate team at Napthens, with more than 20 years of experience supporting clients with private client and Court of Protection matters.

She is a full member of the Society of Trust and Estate Practitioners (STEP) and a specialist in the preparation of wills incorporating life interest trusts and discretionary trusts, inheritance tax planning advice, probate and administration of testate and intestate estates, including estates with an international element and contested estates.

In addition, Rosemary supports people and families with deeds of variation, lasting powers of attorney for property and financial affairs/health and welfare and preparation of personal injury trusts to safeguard awards of personal injury compensation.

She has extensive knowledge and experience of dealing with Court of Protection matters, ranging from vulnerable and elderly clients to children and adults with acquired brain injuries.  She has also made successful applications to court for the approval of statutory wills and family care payments.

Rosemary has been involved in cases involving financial abuse of vulnerable adults and pursuing claims against those responsible for such abuse.

Experience

Previous cases Rosemary has handled include:

  • Acted for executors of an estate involving farmland and successfully applied for agricultural property relief
  • Acted for a personal representative of an estate who lived in America, who discovered her inheritance after being contacted by the treasury solicitor. My client was estranged from her late father and subsequently discovered she had a step-sister and a half-sister. This case involved hostile litigation, and it was necessary to arrange DNA tests to confirm the relationship between my client and her half-sister
  • Appointed by the court as an independent administrator of a disputed estate
  • Managed contested statutory wills applications involving multiple parties and the official solicitor
  • Successfully appealed a decision by the Court of Protection refusing permission to apply for a health and welfare deputyship
