Update to immigration rules

The UK Home Office has amended the existing sponsorship system to introduce the Global Business Mobility, Scale-up and High Potential Individual visa route.

Global Business Mobility Visa routes

The Global Business Mobility Visa routes are due to formally launch at 9am on 11 April 2022. These routes are intended to make it easier for overseas businesses to establish a presence in the UK or transfer staff to the UK.

The Global Business Mobility Visa comprises of five different routes summarised as follows:

  1. Global Business Mobility- Senior or Specialist Worker

This visa category will replace the Intra-Company Transfer route and is intended to be used by senior managers or specialist employees who are being assigned by an overseas company to a UK business (for a temporary period) which is linked by common ownership.

  1. Global Business Mobility- Graduate Trainee

This visa category will replace the Intra-Company Graduate Trainee route and is intended to be used for workers enrolled on a structured graduate training course who are required to perform a work placement in the UK which leads to a managerial or specialist role.

  1. Global Business Mobility- UK Expansion Worker

This visa category will replace the Sole Representative of an Overseas Business route and is intended to be used by senior or specialist workers who will be assigned temporarily to the UK to support an overseas business with expanding its reach to the UK. Please note that this route can only be used if the overseas business does not already hold a trading presence in the UK

NB- the Sole Representative of an Overseas Business route will remain in place for media representatives under this route and those already on such route in the UK will be permitted to extend their stay and settle in the UK.

  1. Global Business Mobility- Service Supplier

This visa category will replace the contractual service supplier and independent professional provisions under the current Temporary Worker – International Agreement route (all other provisions under such route will remain).  The Service Supplier route is intended to allow overseas contracted service suppliers to come to the UK on temporary work assignments or  self-employed independent professionals to come to the UK to provide services under a UK international trade agreement.

  1. Global Business Mobility- Secondment Worker

This is a new route that has been introduced and it is intended to be used by workers who are being temporarily seconded to the UK as part of a high value contract or investment by their overseas employer. The role itself must appear as an eligible job on the Appendix to Skilled Worker visa and must satisfy eligibility requirements under the Global Business Mobility route. In addition, any contract between the UK “host” company and overseas employer must be registered with the Home Office.

Scale-up route visa

The Scale-up visa is intended for individuals who have been recruited by a qualifying Scale-up business . A business will qualify as a scale-up if 20% or more growth of its yearly turnover or staff is achieved and such company has at least 10 employees on its books at the start of such three-year period. The scale up route is also a route to settlement in the UK and is set to launch on 22 August 2022.

High Potential Individual visa

The High Potential Individual visa is aimed at attracting international talent to the UK by allowing graduates from top international Universities (as stipulated by the Global Universities List) to job-seek or undertake full-time or self-employed work in the UK. Graduates will need to have graduated from a qualifying university within the 5 year period prior to applying under this route. For the avoidance of doubt, having a job offer is not a condition of applying under this route. The High Potential Individual route will open at 9am on 30 May 2022.
