Summary

Victoria specialises in disputes involving wills, probate, estates and trusts. On a day to day basis, Victoria advises clients and manages court proceedings on issues of will validity (for example, where there is suspicion that the deceased lacked mental capacity, was unduly influenced to make the will, where the will contains mistakes, or where the will hasn’t been properly executed or is a forgery).

She also advises on Inheritance Act claims (on behalf of a spouse, former spouse, cohabitee, adult child or anyone who was maintained by the deceased); executor and beneficiary disputes (for example, where an executor needs to be removed and beneficiaries’ rights to information); and Probate Registry proceedings where there is a dispute as to the grant of probate or letters of administration.

Victoria also handles disputes relating to co-owned property, such issues often arise out of the context of a surviving spouse or cohabitee or following the breakdown of a relationship.

Victoria frequently handles claims to determine whether jointly owned property should be sold; to quantify the respective beneficial shares of each co-owner or cohabitee; to determine whether a party has a beneficial interest in the property (usually where that party’s name is not on the legal title); and to determine whether property subject to a trust of land should be sold.

Background

Victoria joined Napthens in 2017 having previously worked at another firm where she trained in several legal disciplines before specialising in litigation.

At university Victoria completed her law degree to Masters level and Legal Practice Course (LPC).
