Separation Agreement

Our fixed fee is £750 + VAT (£150)

What does this cover?
  • Meeting with you to discuss details of the proposed agreement
  • Advising you on matters to consider before formalising any agreement
  • Informing you of the financial information required from you
  • Considering the financial information provided by the other party
  • Preparing/approving the agreement
  • Arranging completion of the agreement
Are there any additional costs?
Our fixed fees won’t apply where there is no agreement at the outset and ongoing negotiation is needed. In this situation we could charge at an hourly rate and give you an estimated cost, or we could consider whether an alternative fixed fee arrangement would be suitable for you.

Pre-Nuptial Agreement

Our fixed fee is £1,200 + VAT (£240)

What does this cover?
  • Obtaining information from you in order to draft the agreement
  • Advising you on matters to consider before formalising the agreement
  • Drafting the agreement
  • Informing you of the financial information required from you
  • Completion of the document
Are there any additional costs?
Our fixed fees don’t include negotiations if there is a disagreement or any additional expert reports that may be commissioned. Also, fixed fees don’t apply for agreements where a couple’s assets are worth in excess of £1m.

Children Disputes

Our fixed fee is £750 + VAT (£150) + Court fee

What does this cover?
  • Our fixed fee covers the preparation of a contact application for you and the steps up to, but not including, the first Court hearing.
  • Up to 2 hours work in taking your instructions, corresponding with your partner (or their solicitor) to negotiate agreement
  • Drafting the Court application for you
  • Service upon your partner or solicitor
  • Advising you in relation to the first Court appointment
Are there any additional costs?
If you wish us to attend the first Court appointment for you, we will do so for an additional £500 + VAT (£100) for up to ½ day. Our fixed fee doesn’t include any experts’ reports that may be commissioned. If for any reason the case proceeds beyond a first hearing we would either charge at our hourly rate or discuss a possible alternative fixed fee arrangement.

Financial Settlements / Pensions / Property

Sorting out the financial settlement on divorce is often difficult. Every case is different so it is hard to give an accurate estimate as to fees involved for an individual case. However, we do appreciate that people like to have some certainty about potential costs involved.

Subject to an assessment of the complexity of your case, we may be able to offer fixed fees for negotiating a financial settlement for you without the need for a Court application or for the various stages of dealing with a Court application.

Negotiating a Financial Settlement

Our fixed fee for preparing a Consent Order is £1,500 + VAT (£300) + Court fees.

If it is possible to reach an agreement regarding your property and finances, we can draw up a Consent Order which, if approved by the Court, has the same effect as an order made by Court following a full hearing. (Usually when a Consent Order is negotiated, documentation is approved by the Court without the need for parties to attend.)

What does this cover?
  • Our fixed fee covers the preparation of a Consent Order.
  • Taking your instructions
  • Gathering the financial information from you
  • Correspondence with your partner or their solicitor
  • Exchange of financial information
  • Drafting the Court Order with accompanying financial statement
  • Forwarding documentation to the Court and the Order to you once it has been made

Court Proceedings

If it’s not possible to reach agreement at an early stage, it is likely that an application to the Court will need to be lodged. A Court application can typically be broken down into 3 stages:
Work up to and including the first Court appointment – First Directions Appointment (FDA)
Work up to an including the second Court appointment - Financial Dispute Resolution (FDR)
Work up to and including a final hearing

We offer a fixed fee for work up to and including a FDA at £3,000 + VAT (£600) + Court fees + experts’ fees

And for work up to and including a FDR we offer a fixed fee of £5,000 + VAT (£1000) + Court fees + experts’ fees

If your case does not settle at or before the FDR then the case may need to proceed to a final hearing. For this we would normally revert to an hourly rate but once we have a clear understanding of the issues involved, it may be possible to agree a further fixed fee to include work up to and including a final hearing plus the cost of instructing a barrister on your behalf.

Are there any additional costs?
There is a Court fee of £240 currently for a party issuing a financial application. This is the only Court fee that will be incurred unless and until agreement is reached and a draft Order placed before the Court for approval. At that point a further Court fee of £45 will be incurred – normally shared between the two parties.

Sometimes it is necessary to obtain valuation of property reports from experts and accountants. These fees are payable on top of the fixed fee.
