Summary

David heads up Napthens’ litigation team.  Based in Preston, he specialises in commercial and chancery litigation including the protection and enforcement of contractual rights and remedies, partnership disputes, property litigation (commercial and residential landlord & tenant), agricultural litigation, land law, professional negligence and probate disputes.

David acts for a wide variety of individuals and business clients. His commercial clients include organisations such as Garside Laycock Limited, Lunar Caravans Limited, Kensington Developments Limited, Baxter Construction Limited, Express Linen Services Limited and Laila’ Fine Foods Limited. He has a reputation for precision and the provision of high quality service and advice and is considered to be tenacious, with a dogged persistence until his client receives the desired outcome.
 

Specialisms

David has a wide portfolio of landlord and tenant clients, acting in relation to tenant default issues including possession, forfeiture, rent arrears and dilapidations. He is also a strong land lawyer dealing with rights and remedies associated with disputing land owners, including issues arising out of leases and covenants on title. He is experienced in disputes arising out of business agreements such as sale and supply contracts, Joint Venture Agreements and construction disputes, and matters arising out of the supply of defective products, other goods and services. He acts for the consumer, the dealer and the manufacturer on disputes concerning rights and remedies particularly relating to machinery and equipment, motor vehicles, caravans and mobile homes. David also acts for diverse farming and horticulture industry clients throughout the North West and is a member of Napthens’ National Farmers’ Union (NFU) panel solicitors’ team. He is experienced in inheritance disputes in respect of claims arising out of disputed wills such as lack of testamentary capacity, undue influence, disputes between executors concerning the administration of estates and also claims against estates generally.

Background

David was educated at Kirkham Grammar School where he was awarded Honours. He was admitted as a solicitor in 1993, having qualified at Chester College of Law and joined Napthens in 1995, becoming partner in 2000. He was also formerly employed as a trainee solicitor by Cuddy Woods & Cochrane, who merged with Napthens in 2007. In the past he has worked as a holiday representative in Greece and Austria (winter skiing).  

Memberships and awards

David is accredited as a commercial mediator with the Centre for Effective Dispute Resolution (CEDR). He is also a team solicitor for the NFU panel. He is also an Advanced ASA swimming teacher.
