Safety is ‘snow joke’ warns expert

WITH weather reports warning of further snow and ice, a Lancashire legal expert is warning of the need for both the public and organisations to make sure they are doing everything they can to prevent accidents.
More than 20 people have reportedly died in weather related accidents in the UK since before Christmas, and many areas of the county still have ice and snow affecting journeys by foot and by car.

Now Terry Griffin, head of Personal Injury at Napthens solicitors, is warning of the need for individuals, businesses and other organisations to take care and be aware of what can happen when steps are not taken to keep premises and places safe.

He warns that most accidents in such weather will occur on public roads and footpaths, which are the responsibility of the local authority which has a duty of care to ensure safe passage as far as reasonably practicable – for instance gritting.

Employers and occupiers also need to keep premises – including land, areas or pathways owned by them or under their control – safe.

Terry said: “It is not just businesses and organisations that have a duty imposed on them by the law. Private individuals must also take care to ensure visitors are safe on their property – for instance a postman or milkman.

“However, be wary of clearing pathways – by removing snow you may be creating more danger than you are eliminating and may be liable for a claim of negligence or nuisance.

“Drivers must also take care to avoid any journey that is not absolutely necessary and be aware that if they slide into another vehicle, they will be held liable despite the prevailing weather conditions.

“The AA website and Health and Safety Executive website both provide some useful tips.”
